1. Overview

Vizually.AI respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using the Vizually.AI platform.

2. Reporting Copyright Infringement

If you believe that content hosted on Vizually.AI infringes your copyright, please submit a DMCA takedown notice to our designated agent with the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing, with enough detail for us to locate it (e.g., URL, project name, or description)
  4. Your contact information: name, address, telephone number, and email address
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the owner's behalf

4. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification with:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
  4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal court in your district (or Delaware if outside the U.S.), and that you will accept service of process from the person who filed the original DMCA notice

Upon receiving a valid counter-notification, we may restore the removed content within 10–14 business days unless the original complainant notifies us of a court action.

5. Repeat Infringers

In accordance with the DMCA, we will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances.

6. Good Faith

Please be aware that submitting a false DMCA notice or counter-notification may result in legal liability. We encourage you to consult with a legal professional before submitting a notice if you are unsure whether your rights have been infringed.
